Commercial barrister 2022-

While at Bell Gully I focussed on infrastructure funding, financing and development and on a wide range of financing transactions (in particular project and property finance). I was closely involved in the introduction of public private partnership (PPP) procurement to New Zealand, and assisted the Treasury on its establishment of the New Zealand model PPP contract framework.

I subsequently led the Bell Gully teams advising the Crown on the first eight New Zealand PPP projects, being the Auckland South Corrections Facility at Wiri, the Auckland Prison redevelopment, Waikeria Prison, the Transmission Gully and Pūhoi to Warkworth motorways, and three schools bundles.  I have acted for sponsors and financiers on a range of electricity generation, oil and gas and water storage/irrigation projects, and for principals on vertical and horizontal construction projects.​

I advised Crown Infrastructure Partners Limited on the innovative Milldale infrastructure financing transaction, and continue to act for them in relation to infrastructure funding and financing matters.

I have acted for creditors and insolvency practitioners on several large restructurings and insolvencies across a range of sectors, as well as providing general corporate insolvency advice.

I was ranked by the IFLR1000 2022 as ‘highly regarded’ in a number of areas, including restructuring and insolvency, energy and infrastructure, project development, banking, and project finance.

The Legal 500 Asia Pacific 2021 included me in their 'Hall of Fame' for projects and recommended me for transport law and banking and finance. Previous editions described me as a "market leader in PPPs" and an "exceptional negotiator who has an excellent approach to problem solving". I was also named as a leading individual in Chambers Asia Pacific 2021.

Infrastructure, housing and construction​

New Zealand public private partnership (PPP) framework
Advised the Treasury on the development of its model contractual terms for central government PPPs in New Zealand.

Transport PPPs
Advised New Zealand Transport Agency on the procurement of the Transmission Gully and Pūhoi to Warkworth state highway projects, utilising the PPP model.​

Social Housing Reform Programme
Acted for the Treasury and Ministry of Social Development in connection with the design and implementation of the social housing reform programme and transactions under this programme.

Wellington Convention and Exhibition Centre
Advised Wellington City Council on the proposed Wellington Convention and Exhibition Centre (construction and management contracts).

Wellington Town Hall

Advised Wellington City Council on the seismic strengthening and refurbishment project for the Wellington Town Hall.​

Prison PPPs​
Advised the Department of Corrections on the Men's Prison at Wiri PPP project and the Auckland Prison Redevelopment PPP project, based at Paremoremo and the Waikeria Prison PPP.

Schools PPPs
Advised the Ministry of Education on its three schools PPP projects.

Western Porirua public housing partnership
Advised Kāinga Ora – Homes and Communities on the successful western Porirua public housing partnership with Ngāti Toa.​

Crown Infrastructure Partners

Acted for Crown Infrastructure Partners on the design and implementation of the Milldale infrastructure financing project and on its proposed transactions under the Infrastructure Funding and Financing Act 2020.

Ruataniwha Water Storage Scheme​
Advised Hawke's Bay Regional Investment Company on the proposed Ruataniwha Water Storage Scheme and several other proposed water storage projects.

Banking and Finance​

Property finance

Acted for banks and borrowers on numerous property financing transactions, including investment portfolios and development projects, and including various multi-sourced financings.

Project financing - social infrastructure

Acted, primarily for the Crown, on the interface between Crown contracts and counterparties' private financing (see projects above)

Project financing - power and upstream
Acted for sponsors and lenders on the project financing of gas fired power stations and wind projects, and upstream borrowing base facilities, in New Zealand and internationally.

Acted for a range of listed companies on their financing requirements, under both negative pledge and secured models.

USPP

Advised a number of New Zealand based clients on the New Zealand elements of USPP financing and restructuring.​​
